Terms and Conditions

These terms protect BidArchitex while setting clear expectations for professional, business-facing use of the product.

Agreement to these terms

These Terms and Conditions govern access to and use of the BidArchitex website, demo, chatbot, early access workflows, internal tools, reports, and related product experiences.

By using BidArchitex, you represent that you have authority to act on behalf of yourself or the organization you represent and that you will use the service only for lawful business purposes.

What BidArchitex provides

BidArchitex provides risk intelligence for preconstruction and related risk-assessment workflows, including estimate confidence, quote coverage, scope ambiguity, material volatility, cost exposure, schedule pressure, labor assumptions, and compliance-related risk signals.

Outputs are decision-support materials. They are designed to help professional teams identify, price, qualify, transfer, or resolve risk before committing to a bid, contract, procurement plan, or business decision.

User responsibilities

Users are responsible for the accuracy, completeness, legality, confidentiality, and authorization status of all information submitted to BidArchitex.

Users must not submit documents, drawings, estimates, quotes, personal information, trade secrets, regulated data, or third-party materials unless they have the right to do so.

Users remain responsible for final bid decisions, contract terms, project assumptions, professional approvals, procurement commitments, and communications with owners, agencies, subcontractors, suppliers, and advisors.

Risk intelligence, not professional services

BidArchitex does not provide legal, financial, insurance, engineering, architectural, surveying, code-approval, accounting, tax, or procurement advisory services.

No report, score, chatbot response, benchmark, forecast, recommendation, or dashboard should be treated as a guarantee, certification, code approval, lending decision, professional opinion, or substitute for professional judgment.

Construction and risk-assessment decisions involve uncertainty, local conditions, contracts, laws, codes, market changes, supplier behavior, labor availability, weather, and facts outside BidArchitex's control.

Acceptable use

Users may not misuse BidArchitex, interfere with the service, attempt unauthorized access, reverse engineer non-public systems, upload malicious content, violate law, infringe rights, or use outputs to mislead another party.

Users may not use BidArchitex to make automated decisions about individuals, credit, employment, insurance, housing, or regulated eligibility unless a separate written agreement expressly permits that use.

Intellectual property and feedback

BidArchitex owns its website, brand, designs, software, risk methodology, analysis structure, report formats, workflows, and related intellectual property, except for materials owned by users or third parties.

Users retain ownership of their submitted project materials. Users grant BidArchitex the rights needed to host, process, analyze, display, store, and transmit submitted materials for service operation and improvement.

If users provide suggestions, ideas, or feedback, BidArchitex may use them without restriction or obligation.

Payments, subscriptions, and early access

Paid plans, pilots, subscriptions, or enterprise engagements may be governed by additional order forms, checkout terms, or written agreements.

Prices, features, availability, and early access eligibility may change as the product evolves. BidArchitex may accept, reject, suspend, or terminate early access requests at its discretion.

No warranties

BidArchitex is provided on an as-is and as-available basis to the maximum extent permitted by law.

BidArchitex does not warrant that the service will be uninterrupted, error-free, secure, complete, current, or accurate, or that outputs will prevent losses, improve margins, win bids, obtain approvals, avoid disputes, or predict future conditions perfectly.

Limitation of liability

To the maximum extent permitted by law, BidArchitex will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost-profit, lost-revenue, lost-opportunity, lost-data, bid-loss, project-loss, or business-interruption damages.

To the maximum extent permitted by law, BidArchitex's total liability for any claim related to the service will not exceed the amount paid to BidArchitex for the service giving rise to the claim during the three months before the event giving rise to liability, or one hundred dollars if no fees were paid.

Changes, suspension, and termination

BidArchitex may update these terms, modify the service, suspend access, or terminate access for misuse, legal risk, security risk, nonpayment, or violation of these terms.

Continued use after updated terms are posted means the updated terms apply.
